RESUMEN: En el presente artículo se intentará demostrar que la libertad de conciencia y religiosa conforman un único derecho que tienen como fin proteger las creencias e ideologías de las personas, independientemente de su carácter religioso o secular. Por ende, se sostendrá que la fórmula adoptada por el sistema jurídico colombiano de promover el fenómeno religioso es contraria al principio de igualdad porque privilegia una visión del mundo teísta frente a otras visiones, también válidas en un Estado constitucional y pluralista (...) como el colombiano.ABSTRACT: In this article we will try to demonstrate that the freedom of conscience and religion constitute a single right that have as a purpose to protect the beliefs and ideologies of people, regardless of their religious or secular character. The purpose of this study is to determine empirically the state of the art of the medical care, when healthcare personal is confronted with ethical dilemmas related with the care they give to the geriatric population. An observational, longitudinal, prospective and qualitative study was conducted by analyzing the correlation between healthcare personnel–patient relationship, and ethical judgments regarding dilemmas that arise in daily clinical practice with geriatric patients. Mexican healthcare personnel with current active practices were asked to write up an ethical (...) dilemma that arose frequently or that had impacted their medical practice. From the narrative input, we were able to draw up a database with 421 dilemmas, and those corresponding to patients 60 years and older were selected (n = 54, 12.8 %). The axiological analysis of the narrative dilemmas of geriatric patients was made using dialectical empiricism. The axiological analysis values found most frequently were classified into three groups: the impact of healthcare, the roles of the physician, and refusal of therapy; the healthcare role of educator, caring for the patients’ life and the risk of imminent death where the values found more often. The persistence and universality of certain dilemmas in geriatrics calls for awareness and requires a good training in the ethical discernment of these dilemmas. This would help to improve substantially the care and the life quality of this population. (shrink)

Lower extremity non-contact soft tissue injuries are prevalent in elite futsal. The purpose of this study was to develop robust screening models based on pre-season measures obtained from questionnaires and field-based tests to prospectively predict LE-ST injuries after having applied a range of supervised Machine Learning techniques. One hundred and thirty-nine elite futsal players underwent a pre-season screening evaluation that included individual characteristics; measures related to sleep quality, athlete burnout, psychological characteristics related to sport performance and self-reported perception of chronic (...) ankle instability. A number of neuromuscular performance measures obtained through three field-based tests [isometric hip strength, dynamic postural control and lower extremity joints range of motion ] were also recorded. Injury incidence was monitored over one competitive season. There were 25 LE-ST injuries. Only those groups of measures from two of the field-based tests, as independent data sets, were able to build robust models [area under the receiver operating characteristic curve score ≥0.7] to identify elite futsal players at risk of sustaining a LE-ST injury. Unlike the measures obtained from the five questionnaires selected, the neuromuscular performance measures did build robust prediction models. The inclusion in the same data set of the measures recorded from all the questionnaires and field-based tests did not result in models with significantly higher performance scores. The model generated by the UnderBagging technique with a cost-sensitive SMO as the base classifier and using only four ROM measures reported the best prediction performance scores. The models developed might help coaches, physical trainers and medical practitioners in the decision-making process for injury prevention in futsal. (shrink)

Latin American and Latinx philosophers have a long and rich history of deep engagement in public life through a variety of different projects and venues. This chapter offers a brief survey of the historical development and practice of philosophy in public life in Latin American and Latinx traditions. Because of their unique histories, it engages public philosophy in Mexico and Argentina separately. The chapter shows that a guiding thread in Argentinian public philosophy is a deep‐rooted concern about the threats created (...) by political and intellectual authoritarianism and strategies for pushing back against this oppression by developing emancipatory practices and democratic alternatives. This work runs through a long line of Argentinian philosophers from José Ingenieros and Alejandro Korn to María Lugones and Diana Maffía. Public philosophy is clearly a vibrant and ongoing enterprise in contemporary Mexico. Argentina also possesses a long and rich tradition of public philosophy. (shrink)

It is undeniable that human agents sometimes act badly, and it seems that they sometimes pursue bad things simply because they are bad. This latter phenomenon has often been taken to provide counterexamples to views according to which we always act under the guise of the good. This paper identifies several distinct arguments in favour of the possibility that one can act under the guise of the bad. GG seems to face more serious difficulties when trying to answer three different, (...) but related, arguments for the possibility of acting under the guise of the bad. The main strategies available to answer these objections end up either undermining the motivation for GG or failing to do full justice to the nature of perverse motivation. However, these difficulties turn out to be generated by focusing on a particular version of GG, what I call the “content version”. But we have independent reasons to prefer a different version of GG; namely, the “attitude version”. The attitude version allows for a much richer understanding of the possibility of acting on what we conceive to be bad. Drawing on an analogy with theoretical akrasia and theoretical perversion, I try to show how the attitude version can provide a compelling account of perverse actions. (shrink)

In trying to explain the possibility of akrasia , it seems plausible to deny that there is a conceptual connection between motivation and evaluation ; akrasia occurs when the agent is motivated to do something that she does not judge to be good . However, it is hard to see how such accounts could respect our intuition that the akratic agent acts freely, or that there is a difference between akrasia and compulsion. It is also hard to see how such (...) accounts could be extended to the realm of theoretical reason, but this is generally not taken Ito be a problem, because it is generally assumed that there is no similar phenomenon in the realm of theoretical reason. This paper argues that there is such a thing as theoretical akrasia, and that we can find a characterization of this phenomenon in Descartes’s Meditations. Drawing on certain passages in the Meditations, we can construct an account of theoretical akrasia; this account can then be adapted to resolve the original problem of akrasia in the realm of practical reason. The account asserts that there is a conceptual connection between motivation and evaluation in free action; it also enables us to show how the akratic agent is still acting freely when he does something that he does not judge to be the best all things considered. The pharmaceutical industry, in its marketing efforts, often turns to “key opinion leaders” or “KOLs” to disseminate scientific information. Drawing on the author's fieldwork, this article documents and examines the use of KOLs in pharmaceutical companies’ marketing efforts. Partly due to the use of KOLs, a small number of companies with well-defined and narrow interests have inordinate influence over how medical knowledge is produced, circulated, and consumed. The issue here, as in many other cases of institutional corruption, is that a (...) few actors have accumulated the power to shape the information on which many others base their decisions. Efforts to address this corruption should focus on correcting large imbalances in the current political economy of medical knowledge. A sequestration of pharmaceutical research and development on one hand from pharmaceutical marketing on the other, though difficult to achieve, would address this and many other problems. (shrink)

Constitutivists have tried to answer Enoch’s “schmagency” objection by arguing that Enoch fails to appreciate the inescapability of agency. Although these arguments are effective against some versions of the objection, I argue that they leave constitutivism vulnerable to an important worry; namely, that constitutivism leaves us alienated from the moral norms that it claims we must follow. In the first part of the paper, I try to make this vague concern more precise: in a nutshell, it seems that constitutivism cannot (...) provide an adequate account of the relation between the constitutive norms of agency and the particular ends the agent pursues. I then provide a broad outline of an interpretation of Kant’s formalism that is immune to this objection. I conclude that constitutivism is best understood as the upshot of a formalist view of categorical practical principles. (shrink)

The purpose of this essay is to articulate a specific desideratum for any theory of Latinidad, namely, that there is no adequate conception of Latinx without an attendant conception of Afro-Latinx. In order to be reflective of those whom it purports to describe in the U.S. and elsewhere in the hemisphere, the term Latinx must be plastic enough to encompass the many internal differences, and even antagonisms, between its different constituent parts. Within it, we argue here in particular, it must (...) include its Afro-descended history, which includes not just African-descended people but also a denial of the influences of African-descended culture writ large. Our central claim here, then, is that a certain African-descendedness is constitutive of Latinidad in multiple registers, including history, cultural practices, and social identificatory processes despite Latinidad’s pernicious exclusionary history. Most philosophers working in moral psychology and practical reason think that either the notion of "good" or the notion of "desire" have central roles to play in our understanding of intentional explanations and practical reasoning. However, philosophers disagree sharply over how we are supposed to understand the notions of "desire" and "good", how these notions relate, and whether both play a significant and independent role in practical reason. In particular, the "Guise of the Good" thesis - the view that desire (...) (or perhaps intention, or intentional action) always aims at the good - has received renewed attention in the last twenty years. Can one have desire for things that the desirer does not perceive to be good in any, or form intentions to act in way that one does not deem to be good? Does the notion of good play any essential role in an account of deliberation or practical reason? Moreover, philosophers also disagree about the relevant notion of good. Is it a purely formal notion, or does it involve a substantive conception of the good? Is the primary notion, the notion of the good for a particular agent, or the notion of good simpliciter? Does the relevant notion of good make essential appeal to human nature, or would it in principle extend to all rational beings? While these questions are central in contemporary work in ethics, practical reason, and philosophy of action, they are not new; similar issues were discussed in the ancient period. This volume of essays aims to bring together "systematic" and more historically-oriented work on these issues. (shrink)

This book provides both an introduction to the philosophy of scientific modeling and a contribution to the discussion and clarification of two recent philosophical conceptions of models: artifactualism and fictionalism. These can be viewed as different stances concerning the standard representationalist account of scientific models. By better understanding these two alternative views, readers will gain a deeper insight into what a model is as well as how models function in different sciences. Fictionalism has been a traditional epistemological stance related to (...) antirealist construals of laws and theories, such as instrumentalism and inferentialism. By contrast, the more recent fictional view of models holds that scientific models must be conceived of as the same kind of entities as literary characters and places. This approach is essentially an answer to the ontological question concerning the nature of models, which in principle is not incompatible with a representationalist account of the function of models. The artifactual view of models is an approach according to which scientific models are epistemic artifacts, whose main function is not to represent the phenomena but rather to provide epistemic access to them. It can be conceived of as a non-representationalist and pragmatic account of modeling, which does not intend to focus on the ontology of models but rather on the ways they are built and used for different purposes. The different essays address questions such as the artifactual view of idealization, the use of information theory to elucidate the concepts of abstraction and idealization, the deidealization of models, the nature of scientific fictions, the structural account of representation and the ontological status of structures, the role of surrogative reasoning with models, and the use of models for explaining and predicting physical phenomena. In this paper, I explore a new type of semiotic translation in the context of Audiovisual Translation Studies (AVTS). To that end, a set of formulaic sequencesbestowed of pragmalinguistic value (hedging strings) is analysed. It is argued that the semiotic analysis of conversational features in English may contribute to facilitate their pedagogical exploitation in English as a Foreign Language (EFL) classrooms. This analysis builds theoretically on a semiotic translational framework termed Semiosic Translation (and its subset, Semiosic Subtitling) predicated upon three (...) types of translation: (i) Metaleptic translation; (ii) indexical translation; and (iii) translation as dynamic discontinuity. Th e translational rationale thus arrived at is deemed to account for what it is that binds together linguistic signs with other sign systems. (shrink)

In Part I of this series [A. Poveda, A. Rinot and D. Sinapova, Sigma-Prikry forcing I: The axioms, Canad. J. Math. 73(5) (2021) 1205–1238], we introduced a class of notions of forcing which we call [Formula: see text]-Prikry, and showed that many of the known Prikry-type notions of forcing that center around singular cardinals of countable cofinality are [Formula: see text]-Prikry. We showed that given a [Formula: see text]-Prikry poset [Formula: see text] and a [Formula: see text]-name for a non-reflecting (...) stationary set [Formula: see text], there exists a corresponding [Formula: see text]-Prikry poset that projects to [Formula: see text] and kills the stationarity of [Formula: see text]. In this paper, we develop a general scheme for iterating [Formula: see text]-Prikry posets and, as an application, we blow up the power of a countable limit of Laver-indestructible supercompact cardinals, and then iteratively kill all non-reflecting stationary subsets of its successor. This yields a model in which the singular cardinal hypothesis fails and simultaneous reflection of finite families of stationary sets holds. (shrink)

We consider a 2-valued non-deterministic connective \({\wedge \!\!\!\!\!\vee }\) defined by the table resulting from the entry-wise union of the tables of conjunction and disjunction. Being half conjunction and half disjunction we named it _platypus_. The value of \({\wedge \!\!\!\!\!\vee }\) is not completely determined by the input, contrasting with usual notion of Boolean connective. We call non-deterministic Boolean connective any connective based on multi-functions over the Boolean set. In this way, non-determinism allows for an extended notion of truth-functional connective. Unexpectedly, this very simple connective and the logic it defines, illustrate various key advantages in working with generalized notions of semantics (by incorporating non-determinism), calculi (by allowing multiple-conclusion rules) and even of logic (moving from Tarskian to Scottian consequence relations). We show that the associated logic cannot be characterized by any finite set of finite matrices, whereas with non-determinism two values suffice. Furthermore, this logic is not finitely axiomatizable using single-conclusion rules, however we provide a very simple analytic multiple-conclusion axiomatization using only two rules. Finally, deciding the associated multiple-conclusion logic is \(\mathbf {coNP}\) -complete, but deciding its single-conclusion fragment is in \({\mathbf {P}}\). (shrink)

Roughly 40% of the sizeable medical research and literature on recently approved drugs is “ghost managed” by the pharmaceutical industry and its agents. Research is performed and articles are written by companies and their agents, though apparently independent academics serve as authors on the publications. Similarly, the industry hires academic scientists, termed key opinion leaders, to serve as its speakers and to deliver its continuing medical education courses. In the ghost management of knowledge, and its dissemination through key opinion leaders, (...) we see the pharmaceutical industry attempting to hide or disguise the interests behind its research and education. Accidie, depression, and dejection seem to be psychological phenomena that are best characterized as cases in which an agent has no motivation to pursue what he or she judges to be good or valuable. The phenomena thus seem to present a challenge to any view that draws a close connection between motivation and evaluation. ‘Accidie, Evaluation, and Motivation’ aims to show that the phenomena are actually best explained by a theory that postulates a conceptual connection between motivation and evaluation.

Para un enfoque de ese tipo, la explicación del origen de las modalidades del juicio, en general, y la negación, en particular, plantea peculiares desafíos. El presente trabajo discute el modo en el que Husserl trata la negación, en tanto forma básica de la modalidad, tanto en el enfoque estático de Ideen (...) I como en el enfoque genético de Erfahrung und Urteil. A fin de poner de relieve el al-cance histórico y sistemático de la concepción husserliana, se proporciona previamente una presentación general de su contexto polémico inmediato. Este viene dado por la oposición entre psicologismo y formalismo, dominante en la filosofía de la lógica alemana de fines del siglo XIX y comienzos del siglo XX.Husserl develops a genetic approach that seeks to account for the origin of the logical-categorical forms starting from the corresponding pre-structures located at the level of sensitive receptivity. For such an approach, the explanation of the origin of the modalities of judgment, in general, and negation, in particular, poses peculiar challenges. This paper discusses how Husserl treats negation as a basic form of modality, both in the static approach of Ideen I and the genetic approach of Erfahrung und Urteil. Previously, in order to highlight the historical and systematic significance of the Husserlian conception, a general presentation of its immediate polemic context is offered, especially with reference to the opposition between psychologism and formalism, dominant in the German philosophy of logic of the late nineteenth and early twentieth century. This chapter discusses some strategies pharmaceutical companies employ to establish influence and even hegemony over domains of medical knowledge: marketing products via medical research and education. The chapter thus contributes to understanding the political economy of knowledge in this industry. As a counterpart to traditional epistemology, studying the political economy of knowledge shifts attention from individual claims and their justifications to some of the forces available to shape terrains on which claims are produced, distributed, and consumed.Of pharmaceutical companies’ clinical research, (...) 70–75% is performed by contract research organizations. CROs conduct trials with one eye to the drug approval process and the other to the marketing of products. On the basis of trial data, analyzed by pharmaceutical company statisticians and scientists, publication planners design suites of scientific manuscripts and hire ghostwriters to write them. These are then given to academic authors, who generally have had little prior connection to the research, analysis, or writing. The manuscripts are published in medical journals appropriate for the audiences the companies wish to reach.The doctors and researchers with whom companies engage most closely are generally termed key opinion leaders. In addition to authoring manuscripts, KOLs serve companies in a number of roles, but most prominently as speakers—at professional meetings, in after-dinner and similar settings arranged by sales representatives, and in continuing medical education courses, which doctors must take to keep their licenses. Research, education, and marketing, then, are often fused. (shrink)

The paper explores the effects of social disablement caused by imprisonment, analyzing how this institution can exacerbate existing disability conditions or create new ones. Through a review of sociological literature, it highlights how the prison context can significantly contribute to an additional level of disablement. Considering the incapacitating effects of imprisonment, it emerges that the prison system acts as a “producer” of social disablement, intensifying marginalization processes and increasing societal disparities. This process is fueled by prison overcrowding, loss of employment (...) and housing, suspension of social assistance, and the breakdown of family ties, creating a vicious cycle that generates and reinforces social disablement. The article underscores the need for greater attention and research in the field of disability within the prison environment, considering the dynamic interaction between individual conditions and contextual factors that influence it. Furthermore, it calls for a critical reflection on the social function and practices of prison institutions, proposing a more inclusive approach that reconsiders penal structures and policies to mitigate the disabling effects of detention. Así como se ha hablado en los años 60 y 70 de un giro lingüístico de la filosofía, de igual manera, se puede hablar hoy también de un giro hermenéutico, que no carece de vínculos con el anterior, y que ha dado lugar a una suerte de nuevo paradigma que marca el estilo y los caminos de buena parte del pensamiento filosófico del presente. Bajo qué condiciones pudo tener lugar la peculiar transformación de la problemática filosófica que el mencionado giro (...) hermenéutico trajo consigo es una pregunta que no resulta fácil de responder. Tras una caracterización de la noción de hermenéutica en sus usos más importantes, en el presente trabajo se intenta proveer una respuesta tentativa a dicha pregunta, identificando los principales factores concurrentes que dan lugar al giro hermenéutico de la filosofía contemporánea. Luego, se ofrece una reconstrucción de lo que puede llamarse la reformulación hermenéutica de la idea de la racionalidad, con arreglo a algunos de sus principales rasgos característicos. Por último, se aborda, sobre esa base, algunos de los aspectos centrales en la discusión actual en el ámbito de la teoría de la interpretación. Particularmente, se discute algunos de los problemas vinculados con la tesis del primado metódico de la presuposición de sentido, y se ofrecen argumentos a favor de su carácter básico, incluso allí donde el tipo de actitud general que se intenta cultivar corresponde a lo que ha dado en llamarse hermenéutica de la sospecha. El presente trabajo examina la crítica de Heidegger a la concepción kantiana de la libertad como un tipo peculiar de causa. Con ella Kant consuma tendencias operantes en una larga tradición, cuyos orígenes remontan a la ontología griega, que documenta la comprensión del ser como presencia. Pero el enfoque causal de la libertad no permite hacer justicia a sus raíces más profundas en la propia trascendencia del Dasein.

The paper describes how a simple idea, that of a new foundation of moral philosophy taking Galilean new natural philosophy as a mode , lead to unforeseen developments once the competition between a Cartesian and a Newtonian paradigm emerged. Those developments are reconstructed in Hume, Smith, Ferguson.

The author reexamines a number of foundational episodes in the history of western thought through the prism of the notion of “identity philosophy,” a category that includes both parmenidean metaphysics, predicated on the assumption of a transparent relationship between reality and logos, to the exclusion of the irrational and the nothing from the number of thinkable realities, and a Wittgenstein-influenced philosophy of language implying that nothing can be said unless it has previously been fitted to the mathematical form of linguistic (...) articulation that is logics. The question arises of the truth value and sense of dimensions that eludes identity: event, tale and myth. The fact of literature implies that these dimensions somehow partake of truth and sense, but certainly not in the same way as philosophical discourse. How does this happen? What sort of legitimacy can literature draw from philosophy? What does it mean to step beyond Wittgenstein and speak of “narrative thought?”. (shrink)

The paper discusses the relationship between Adam Smith’s economic doctrines and his ethical doctrines in the light of the “Lectures on Jurisprudence”. The main claim is a comparatively autonomous status of economic discourse, an autonomy granted not by dismissal of ethical claims but instead precisely by a given constellation of claims, on liberty, justice, equality, prudence and benevolence.

Background Compulsory treatments represent a legal means of imposing treatment on an individual, usually with a mental illness, who refuses therapeutic intervention and poses a risk of self-harm or harm to others. Compulsory outpatient treatment in psychiatry, also known as community treatment order, is a modality of involuntary treatment that broadens the therapeutic imposition beyond hospitalization and into the community. Despite its existence in over 75 jurisdictions worldwide, COT is currently one of the most controversial topics in psychiatry, and it (...) presents significant ethical challenges. Nonetheless, the ethical debate regarding compulsory treatment almost always stops at a preclinical level, with the different ethical positions arguing for or against its use, and there is little guidance to support for the individual clinicians to act ethically when making the decision to implement COT. Main body The current body of evidence is not clear about the efficacy of COT. Therefore, despite its application in several countries, evidence favouring the use of COT is controversial and mixed at best. In these unclear circumstances, ethical guidance becomes paramount. This paper provides an ethical analysis of use of COT, considering the principlist framework established by Ross Upshur in 2002 to justify public health interventions during the 2002–2004 severe acute respiratory syndrome outbreak. This paper thoroughly examines the pertinence of using the principles of harm, proportionality, reciprocity, and transparency when considering the initiation of COT. Conclusion Ross Upshur’s principlist model provides a useful reflection tool for justifying the application of COT. This framework may help to inform sounder ethical decisions in clinical psychiatric practice. (shrink)
